Boulder Town Planning Commission
Public Meeting
July 13, 2006, 8:00 p.m.


Commissioners present: Connie Reid, Eric Feiler, and Mike Nelson. Brian Dick and Elaine Roundy were absent. Also present were secretary, Peg Smith; and Planning Coordinator, Curtis Oberhansly.
Members of the public included Clifford Fuller, Sergio Femenias, Pete and Cookie Schaus.


Meeting Agenda

• Review and approve meeting agenda and June 22 minutes
• Discuss revisions to street standards/master plan in sub-division ordinance (Ordinance 49B)

Mike called the meeting to order at 8:07 p.m. Approval of the June 22 minutes was postponed until July 27.


Discuss Revisions to Ordinance 49B
The Commission reviewed the proposed revisions to 49B. Streets are among the most important safety-related considerations that a town deals with, and the revisions address refined definitions of streets and roads. Questions to be considered include specified road widths; rights of landowners to fence out cattle, install gates; etc.

Commissioners agreed that Boulder isn’t in the situation now to be able to dedicate all streets. An alternative is to identify private streets that are maintained by homeowners’ associations or a road association recorded on a plat. Within the sub-division process, Boulder needs a method to define the benefit and the burden of road ownership. Typically, sub-dividers would deed road ownership to the landowners. In a clearly defined enabling document, the property owners’ association would bear liability for road maintenance or lack thereof. The Planning Commission would then be the responsible for reviewing the association set up, and the town would approve it. Homeowner association corporation papers would become part of the recorded plat with the state of Utah.

Curtis suggested that town ordinances not include specifications for road engineering because conditions are so dependent on area sub soils. An engineer could evaluate an area and make recommendations on road build-up, draining, etc.

The other proposed revision was that the Planning Commission “may” require submission of a master plan describing central utility corriders, traffic patterns, and other infrastructure elements.
Connie made a motion to have Bruce Parker check over the proposed revisions before recommending them to the Town Council. Eric seconded the motion, and all approved. Curtis agreed to email a copy to Mr. Parker.

Hear Clifford Fuller Conceptual Plan for Sub-Division
Clifford had submitted copies of maps and paperwork to Judi Davis, Curtis, and Commissioners prior to the meeting. His main questions for the Commission regarded responsibility for the roads and Farmstead water hookups.

Connie agreed with Clifford that it doesn’t make sense for him to have to change from 4 inch to 8-inch pipe at his property line, but Tristan DeMille, of Jones and DeMille, had told her that all future hookups require 8 inch pipe.

Eric asked if the described acreages on the plat exclude the road? Clifford, yes, all lots are now shown as net acreage.

Curtis identified the additional issues that need to be addressed:
1) Does the 50 feet of road easement meet the net acreage requirement? (Clifford said it does.)
2) What is the required size of waterline and how far does it need to extend? (This question remains unanswered.)
3) What improvements would need to be made where? (This includes waterline and roads; with four lots already on the road, the land doesn’t qualify for the road exemption.) He said it is common for towns to require that sub-dividers provide road improvements to landowners. Generally a road can only be dedicated by filing a plat or by ordinance.

Clifford said he needs the information now to help him determine the sales price of the lots. He would like the Commission to find out which roads are dedicated. Curtis replied that usually, when improvements are involved, the preliminary plat would be held, and the town would approve it pending completion of the improvements. He said that a sub-divider can’t sell lots and then tell the buyers that they are obligated to put in any required improvements.

Other questions were on fire hydrants (probably one required), drainage problems (biggest problem is runoff from the highway and may require a culvert), irrigation water (the line only services Clifford’s own property, setbacks (look like no problem). Curtis will check with Judi and then Marvin to see about getting more information on the road dedication question.

Determine Next Agenda
The July 27 meeting will be a discussion on the General Plan draft with revisions identified.
Eric moved to adjourn; Connie seconded the motion. Mike adjourned the meeting at 9 p.m..
