Meeting Minutes
Boulder Town Planning Commission
January 26, 2006, 7:00 p.m.
Commissioners present: Elaine Roundy; Connie Reid; Brian Dick; and substitute chair, Eric Feiler, Mike Nelson was absent. Also present were secretary, Peg Smith; and Planning Consultant, Curtis Oberhansly.
Others attending: Tom Jerome, Tim Clarke, Mark Nelson, Eric Scott, Cynthia Low, Don Montoya, Donna and Robert Owen (and Amber), and Walt Gove.
Eric brought the meeting to order at 7:08 p.m. Connie moved to approve the 11/17/05 minutes, Elaine seconded the motion, and all approved. Connie moved to approve the 1/11/06 minutes, Brian seconded the motion, and all approved. New business on the posted agenda included the following:
• Conduct Public Hearing for Anthony Coombs preliminary plat application for sub-division on two lots fronting Highway 12 and final approval of application.
• Hear Conceptual Plan by Gibbs Smith on one lot sub-division in Lower Boulder.
• Discuss scope of duties for Planning Coordinator and forward recommendation of such to Town Council.
• Discuss procedures for assimilating public input for revising General Plan
• Discuss vacating the Spring/Peterson road.
• Discuss procedures for holding work meetings prior to public hearings, and discuss timelines and deadlines for receiving various applications and submittals.
• Discuss timeframe for roads workshop with Stuart Thompson of LTAP
Coombs Sub-Division
Curtis announced that the public hearing posted for this session could not be conducted given the 7-day (not 3-day) notification requirement in the Boulder Sub-Division ordinance #49, Section 400-6. He instead presented the information as a conceptual plan and plat at the request of Coombs' authorized agent, Cathy Bagley, Boulder Mountain Realty, to familiarize the Commission with their request. Curtis and Bagley agreed that the public hearing would go forward on 2/9/06 after due notice.
Eric questioned the lot status of the third piece of divided property on the east side of Hwy 12 (not part of the 2-lot description provided). Tim thought the applicant should also consult with UDOT regarding access off Highway 12, given that the access is not specified on the plat, and that UDOT has certain requirements about driveways directly off highways. Brian asked a generic question regarding legality of selling unsubdivided lots. Curtis replied that the ordinances and statutes require that a sub-division must be approved and recorded prior to a sale or such sale is void. He found nothing prohibiting advertising or discussing potential sales before or during the subdivision application process. Curtis did not know the legal answer to Eric's question, and also said he would have the applicant contact UDOT to identify possible access points on the plat.
Gibbs Smith Conceptual Plan for 1-Lot Sub-Division
Rod Torgersen, engineer of Gibbs' plat, had asked Curtis to present the plat for the Conceptual Plan. Curtis described a 5.05 acre, single lot sub-division in Lower Boulder. Eric asked for clarification on whether this lot was part of the existing Plats A and B of Boulder Fields sub-division, or whether this was a separate division of those properties. He then asked to be recused from the discussion given his personal opinions about the situation.
Connie said that the Commission needed a clearer specification of whether a sub-division exists in this plan, and if so, that roads and infrastructure must be brought up to ordinance standards.
Following additional discussion the lot and easements required, Connie moved to recommend the town make 60 feet the standard road easement for Boulder Town roads. Elaine seconded the motion, and the commission unanimously approved. Curtis will forward that information to Rod.
Consider Question on Hills N Hollows Tent Campsites
Donna Owen had previously requested time on the agenda to ask a question regarding a zoning use, and was inadvertently omitted from the agenda. The Commission agreed to hear her question. She and Robert wanted to know if it would be feasible to continue work toward placing several tent campsites behind Hills and Hollows, and if so, what town requirements needed to be met. Eric's opinion was that the store is in a commercial zone, and campgrounds are already as appropriate use in a commercial zone; she could apply for a conditional use permit and present appropriate documentation about her plan. Curtis concurred, and added that she would probably need a survey and plat, designate parking, and meet the the necessary SW Health requirements. Eric further suggested looking carefully at page 33 of the Zoning Ordinance and identifying adjacent landowners for future notification. Don Montoya suggested reviewing general standards for preparing and sizing tent sites.
Discuss Scope of Duties for Planning Coordinator
Following brief discussion scope of duties and flow of information among staff, Connie moved to approve a resolution forwarding the draft description shown below to the Town Council for their approval. Elaine seconded the motion, and all approved as follows:
The Planning Commission hereby recommends to the Town Council that it appoint Curtis Oberhansly to act in the capacity of voluntary staff Planning Coordinator to act at the direction and upon the request of the Town Council, the Planning Commission or the Appeal Authority, for the purpose of:
Reviewing land use matters, including applications for subdivisions, variances and appeals for completeness and presenting them to the Zoning Administrator for review and signature;
Presenting applications pursuant to proper notice in meetings or hearings as required by ordinance or statute and to work with the Town Attorney to prepare findings where mandated;
Coordinating with the Town Attorney, Professional Planner, Engineer, or other resources for the purpose of resolving issues when requested and authorized by the foregoing bodies.
Assimilating Input to General Plan
Tom Barlow has been working alone on drafting the comments received into the General Plan. Eric suggested that a work group be formed to assist with wordsmithing of the comments following subsequent General Plan hearings. He asked for volunteers to assist Tom, including at least one Planning Commission member and one Town Council member. The resulting work group will be: Tom Barlow, Tim Clarke (representing the council), Connie Reid (representing the Commission), Curtis, and Walt Gove.
Discussion on Vacating Spring/Peterson Road
Curtis said the only question at this point was whether the Planning Commission was the appropriate body to even hear the issue. He asked to table the discussion until the town attorney can provide an opinion.
Discuss Roads Workshop
Tim talked with Stuart Thompson, of LTAP, about conducting a workshop on road and street specifications. Sydney Fonnesbeck and Stuart need to be scheduled for an evening workshop, probably in March. Peg and Mike Nelson will start coordinating this.
Discuss Procedures: Work Meetings and Deadlines
Work meetings are Planning Commission sessions intended strictly for gathering information that may be necessary preface to a meeting or hearing. As with all Planning Commission meetings, a work meeting is open to the public; a notice would be posted regarding the meeting, but public input is neither solicited, nor necessarily accepted. Such a meeting may immediately precede a regular meeting, or it may be held at a different time and place, depending on need. The Commission will consider how they want to handle work meetings in the future.
Curtis suggested that the Planning Commission hold its regular business meetings on the 2nd Thursday of each month and discuss General Plan on the 4th Thursday. Conducting business on the 2nd Thursday gives the Town Clerk adequate time to prepare and distribute notifications that result from Planning Commission activity and that must be considered at the next Town Council meeting. Connie so moved as a resolution, and Brian seconded. All agreed.
Connie moved to adjourn the meeting, Elaine seconded the motion, and Eric adjourned the meeting at 9:28.
